In re Homeowners of America Insurance Company

215th District Court of Harris County, Trial court case number: 2021-70308

ORDER

Terry Adams, Judge

On September 13, 2024, relator, Homeowners of America Insurance Company, filed a petition for writ of mandamus. Relator's petition challenges the trial court's April 4, 2022 order denying its motion for summary judgment and May 16, 2022 order granting summary judgment in favor of real party in interest, Kyle J. McPike.

In connection with its mandamus petition, relator also filed an "Emergency Motion for Temporary Relief." In its motion, relator requested that the Court "stay the trial court proceedings" pending this Court's consideration of its petition for writ of mandamus. Relator argued that a lack of a stay would result in "the waste of time and resources on discovery and litigation." Specifically, relator requested a stay prior to September 19, 2024, when it has been ordered to respond to written discovery.

Relator's "Emergency Motion for Temporary Relief is denied.

It is so ORDERED.
