ORDER MODIFYING OPINION

FYBEL, J.

It is ordered that the opinion filed herein on July 10, 2008, be modified as follows:

On page 13, in the first full paragraph beginning “This standard is consistent,” at the end of the first sentence, add as footnote 1 the following footnote, which will require renumbering of the subsequent footnote:

1 A criminal defendant does not have a constitutional right to self-representation on direct appeal from a criminal conviction. (Martinez v. Court of Appeal of Cal., Fourth Appellate Dist. (2000) 528 U.S. 152.)

This modification does not effect a change in the judgment.
