MEMORANDUM OPINION

Before Chief Justice Wright and Justices Francis and Lang-Miers

Before the Court is appellee's December 13, 2011 motion to dismiss the appeal. Appellee seeks dismissal on the grounds that appellant has failed to file a brief and pay the required $175 filing fee.

On October 19, 2011, this Court affirmed the trial court's order sustaining the contest to appellant's affidavit of indigence and ordered appellant to pay the $175 filing fee within thirty days. We cautioned appellant that failure to pay the fee may result in dismissal of the appeal without further notice. By letter dated December 21, 2011, the Court notified appellant that if she failed to pay the fee within ten days, the appeal may be dismissed.

As of today's date, appellant has not paid the $175 filing fee. Accordingly, we grant appellee's motion and dismiss this appeal. See Tex. R. App. P. 42.3(c).
