Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Todd Warren Altschul, incarcerated and proceeding pro se, has filed a petition and a supplemental petition for a writ of mandamus. Relator seeks issuance of a writ to compel respondent, the Honorable Ben Hardin, to act on realtor's motion to recuse respondent from hearing relator's application for a court of inquiry proceeding. Relator, representing that Judge Hardin recused himself and the assigned judge signed an order denying relator's application for a court of inquiry proceeding, has filed a motion to voluntarily dismiss the petition as moot.

The petition shows that the underlying case is The State of Texas v. Todd W. Altschul, Cause No. 23557, in the 23rd District Court of Brazoria County, the Honorable Ben Hardin presiding.

We grant relator's motion and dismiss the petition as moot.
