IN RE ALCHEMY TENACITY, LLC; RICHARD PAUL BEAULLIEU; ALCHEMY 2018, LLC; AND ALCHEMY 4, LLC, Relators

ORIGINAL PROCEEDING WRIT OF MANDAMUS

270th District Court Harris County, Texas Trial Court Cause No. 2023-75394.

Panel Consists of Justices Jewell, Zimmerer, and Hassan.

ORDER

PER CURIAM

On Monday, July 15, 2024, relators Alchemy Tenacity, LLC; Richard Paul Beaullieu; Alchemy 2018, LLC; and Alchemy 4, LLC, filed a petition for writ of mandamus in this court. Relators ask this court to order the Honorable Dedra Davis, Judge of the 270th District Court, Harris County, Texas, to vacate the portion of the trial court's order dated June 27, 2024, in trial court number 2023-75394, that grants real party in interest's motion for continuance of a hearing on relators' special appearance to conduct jurisdictional discovery and motion to compel jurisdictional discovery, including the deposition of relator Richard Paul Beaullieu. Relators claim the trial court abused its discretion by permitting the continuance and jurisdictional discovery.

Relators have also filed a motion for emergency stay of all jurisdictional discovery below pending this court's decision on the petition. See Tex. R. App. P. 52.8(b), 52.10.

It appears from the facts stated in the petition and motion that relators' request for relief requires further consideration and that relators will be prejudiced unless immediate temporary relief is granted. We therefore GRANT relators' motion and issue the following order:

We ORDER all jurisdictional discovery in trial court cause number 2023-75394, including the trial court's June 27, 2024 order compelling the deposition of relator Richard Paul Beaullieu, STAYED until a final decision by this court on relators' petition for writ of mandamus, or until further order of this court.

In addition, the court requests MTZ Holdings, LLC, the real party in interest, to file a response to the petition for writ of mandamus on or before August 13, 2024. See Tex. R. App. P. 52.4.
