MEMORANDUM OPINION


Robert Sullivan appeals from an adverse ruling in an ex parte proceeding under section 51.903 of the Government Code in which Sullivan sought a determination of the validity of allegedly fraudulent liens on his airplane. See TEX. GOV'T CODE ANN. § 51.903 (Vernon 2005). Sullivan has now filed a motion "to grant a withdrawal." We construe this as a motion to dismiss the appeal. There is no appellee to file a response. Accordingly, the appeal is dismissed. See TEX. R. APP. P. 42.1(a)(1).
