STIPULATION AND [PROPOSED] ORDER RE HEARING OF INDIAN DAMAGE LAW MOTION
Defendants Singapore Airlines, Ltd. and EVA Airways Corporation, through their counsel of record, Condon Forsyth LLP, and plaintiffs herein through their counsel of record, Greene, Broillet, Panish Wheeler, hereby agree and stipulate as follows:
WHEREAS, pursuant to the Court's Order dated August 2, 2004, there is a hearing scheduled on September 27, 2004, regarding the substance of Indian damage law applicable to these cases;
WHEREAS, counsel for the within parties are attempting to schedule mediations of these cases on September 21st or 24th before the Honorable Judge Dickran Tevrizian;
WHEREAS, the parties would like to prevent the Court from unnecessarily preparing for the hearing scheduled for September 27, 2004, in the event these cases settle during the mediations;
WHEREAS, the parties agree to continue the hearing currently scheduled for September 27, 2004, until October 18, 2004, at 9:30 a.m. or such other date as is convenient for the Court;
WHEREAS, the parties agree that their reply briefs, if any, which are currently scheduled to be filed on September 13, 2004, are now due to be filed on, or before, September 20, 2004;
WHEREAS, if these cases settle during the mediation, making the determination of the substance of Indian damage law moot in these cases, counsel for SIA will immediately notify the Court by telephone and request that the hearing be vacated.
IT IS SO STIPULATED.
IT IS SO ORDERED.
