On Appeal from the 296th Judicial District Court Collin County, Texas Trial Court Cause No. 296-50864-2022.
ORDER
ROBERT D. BURNS, III, CHIEF JUSTICE.
This is an appeal from an order of contempt in an ongoing divorce proceeding. Before the Court are appellant's November 27, 2024 motions for (1) recusal of the trial judge; (2) continuance of the trial, "scheduled for 12-16-24 through 12-17-24;" and (3) temporary orders pending "assignment of an unbiased judge" and new trial date. We take no action on these motions as a contempt order is not appealable, and it appears that we lack jurisdiction over the appeal. See In re Martin, 523 S.W.3d 165, 169 (Tex. App.-Dallas 2017, orig. proceeding) (contempt order is reviewable by petition for writ of mandamus or petition for writ of habeas corpus, depending on whether order involves confinement).
So that the Court may determine the threshold issue of jurisdiction, we ORDER appellant to file, no later than December 19, 2024, a letter brief addressing the Court's concern. Appellee may file any response within ten days of the filing of appellant's letter brief.
The deadline for the filing of the appellate record is SUSPENDED pending the Court's determination of its jurisdiction.
We DIRECT the Clerk of the Court to send a copy of this order to Collin County District Clerk Michael Gould, Official Court Reporter Janet Dugger, and the parties.
