ORDER
This is an appeal of a judgment signed February 24, 2017. The notice of appeal was filed on February 27, 2017.
Texas Rule of Appellate Procedure 20.1(b)(1) provides that when a statement of inability to afford payment of costs was filed in the trial court, the party's indigence status in the trial court carries forward on appeal. The docket sheet attached to the district clerk's letter of assignment to this court indicates that appellant was found indigent by the trial court on June 9, 2015. Therefore, appellant is entitled to proceed without payment of costs. The Brazoria County District Clerk is directed to file the clerk's record by July 3, 2017.
The official court reporter, Renee E. Rape, has informed this court that appellant has not designated any portions of the reporter's record to be prepared. A party proceeding as indigent must still request that the reporter's record be prepared. See Tex. R. App. P. 37.1(c)(1). On May 4, 2017, we notified appellant that unless, by May 19, 2017, he requested the court reporter to prepare the record and provided this court with proof of the request, we might consider and decide those issues or points that do not require a reporter's record. See Tex. App. P. 37.3(c). No such proof has been filed.
Accordingly, we will consider this appeal without a reporter's record. Appellant's brief is due 30 days after the clerk's record is filed.
