Administrative Order No. 2008-9, Repealing Administrative Order No. 98-66

On November 18, 1998, by Administrative Order No. 98-66, the Supreme Court adopted Policies on Orders of Protection and Injunctions Against Harassment in Domestic Violence Cases (replacing the Policies Regarding Protective Orders in Domestic Violence Cases adopted by Administrative Order No. 96-37) and authorized inclusion of the Policies in the Benchbook for Orders of Protection and Injunctions Against Harassment in Domestic Violence Cases.
On June 29, 2007, the Domestic Violence Rules Committee, by and through its chairman, the Honorable William J. O'Neil, Pinal County Superior Court, submitted a final Rule 28 petition to the Supreme Court requesting adoption of newly created statewide domestic violence rules entitled the Arizona Rules of Protective Order Procedure. The proposed protective order rules incorporated the Policies regarding protective orders in domestic violence cases as set forth in Administrative Order No. 98-66 with the exception of the training requirements referenced in Policy No. 14. By Order dated September 5, 2007, the Supreme Court adopted the Arizona Rules of Protective Order Procedure and established an effective date of January 1, 2008. By separate administrative order on this date Policy No. 14 is incorporated into Arizona Code of Judicial Administration § 1-302.
Now, therefore, pursuant to Article VI, Section 3, of the Arizona Constitution,
IT IS ORDERED, nunc pro tunc, that Administrative Order No. 98-66 is repealed as of January 1, 2008.
