DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Queens County, dated December 12, 2023. By order to show cause dated January 10, 2024, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding on the ground that the appellant named in the notice of appeal is not aggrieved (see CPLR 5511). Application by Adonis J. W., in effect, to deem the notice of appeal to reflect that Adonis J. W. is the appealing party.

Now, upon the order to show cause and the papers filed in response thereto and upon the papers filed in support of the application and the papers filed in relation thereto, it is

ORDERED that the application is granted, the notice of appeal is deemed to reflect that Adonis J. W. is the appealing party (see CPLR 2001; Matter of Tagliaferri, 1 N.Y.3d 605), and the caption is amended accordingly; and it is further, ORDERED that the motion to dismiss the appeal is denied.
