ORDER Trial court case number: 2014-35653 Trial court: 269th District Court of Harris County
On May 18, 2016, the relators, Maxine Adams and Cecil Adams, proceeding pro se, filed a petition for a writ of mandamus seeking to order the respondent trial court to dismiss Harris County's interpleader suit, reverse the order denying the relators' no-evidence summary judgment motion, reverse the order denying the relators' Rule 91a motion and issue a judgment for required costs in the 91a hearing, and to tax all costs of the suit to Harris County and Kathleen Keese, in the underlying proceeding.
Also on May 18, 2016, the relators filed an emergency motion for relief seeking a stay of all underlying proceedings pending resolution of its mandamus petition. No response has been filed to the motion to stay or petition by the real parties in interest. However, the relators' motion for a stay does not identify the need for emergency relief pending this Court's resolution of the petition. Accordingly, we deny the relators' motion to stay. See TEX. R. APP. P. 52.10(a), (b).
The Court requests a response to the relators' mandamus petition by any real party in interest. See TEX. R. APP. P. 52.8(b)(1). The response, if any, shall be filed within 30 days from the date of this order. See id. 2, 52.4.
It is so ORDERED. Judge's signature: /s/ Evelyn V. Keyes
