On appeal from 23rd District Court of Matagorda County, Texas.
Before Chief Justice Contreras and Justices Benavides and Tijerina
SUPPLEMENTAL ORDER OF ABATEMENT
Per Curiam
This cause is before the Court regarding preparation of the reporter's record, which was originally due to be filed on or before December 27, 2023. On February 7, 2024, this Court ordered the reporter's record to be filed by February 9, 2024. The reporter's record was not filed.
On February 16, 2024, this Court abated the cause and remanded it to the trial court for findings concerning whether a reporter was present at the hearings and which court reporter is responsible for preparing such a reporter's record. This Court further ordered the trial court to supplement the clerk's record and reporter's record of any proceedings by February 23, 2024.
Appeals in parental termination and child protection cases are governed by the rules of appellate procedure for accelerated appeals but include additional expedited deadlines and procedures. See Tex. R. App. P. 28.4; Tex. R. Jud. Admin. 6.2(a). The intermediate appellate courts are directed to ensure "as far as reasonably possible" that these appeals are brought to final disposition within 180 days of the date the notice of appeal is filed. Tex. R. Jud. Admin. 6.2(a).
Given the nature of these cases and the shortened appellate deadlines, this Court hereby orders the trial court to file its past due findings by Wednesday, March, 6, 2024. If the trial court does not comply, this Court may refer this cause to the State Commission on Judicial Conduct for failure to comply with this Court's orders.
