ORDER GRANTING AMS MOTION FOR SUMMARY JUDGMENT AND JUDGMENT


JUDGMENT SUMMARY

Pursuant to RCW 4.64.030, the following information is hereby provided:

(a) Judgment Creditor: AM Warehouses, Inc. (b) Judgment Debtor: Gannett Co., Inc., d/b/a The Olympian (c) Principal judgment amount: $107,801.47 (d) Interest to date of judgment (from February 1, 2002 — January 10, 2003): $12,191.36 (e) Attorney fees: $0.00 (f) Costs: $0.00 (g) Other recovery amounts: None (h) Principal judgment amount shall bear interest at the rate specified in and which shall be calculated from the date of the entry of the judgment, at a rate equal to the weekly average 1-year constant maturity Treasury yield, as published by the Board of Governors of the Federal Reserve System, for the calendar week preceding the date of the judgment. (i) Attorney fees, costs and other recovery amounts shall bear interest at the rate specified in . (j) Attorney for judgment creditor: Michael E. Gossler of Montgomery Purdue Blankinship Austin. THIS MATTER came on regularly for hearing before the Honorable Barbara Rothstein, United States District Judge, of the above-entitled Court upon AM Warehouses, Inc.'s ("AM") motion for summary judgment. The Court considered the files and records herein, including:

1. Complaint for Turnover of Funds and Money Due;

2. Answer and Demand for July Trial;

3. Declaration of Nick Herbert;

4. Declaration of David Herbig;

5. Declaration of Michael E. Gossler;

6. AM's Motion for Summary Judgment; and being fully advised, finds there are no genuine issues of material fact and AM is entitled to summary judgment as a matter of law;

NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED:

1. AM's motion for summary judgment is hereby GRANTED;

2. AM is hereby granted judgment against defendant Gannett for charges due under the parties' warehouse services agreement in the principal amount of $107,801.47, together with prejudgment interest from February 1, 2002 through January 10, 2003 of $12,191.38. The Clerk of the Court shalt establish a money judgment against Gannett as set forth in the Judgment Summary above.
