In the Interest of A. E. R., Jr. a Child
From the 229th Judicial District Court, Starr County, Texas Trial Court No. DC-21-238-1 Honorable Jose Luis Garza, Judge Presiding
REBECA C. MARTINEZ CHIEF JUSTICE PATRICIA O. ALVAREZ LUZ ELENA D. CHAPA IRENE RIOS BETH WATKINS LIZA A. RODRIGUEZ LORI I. VALENZUELA JUSTICES
ORDER
The clerk's record has been filed in this appeal. Under Texas Rule of Appellate Procedure 34.5(c), if a relevant item has been omitted from the clerk's record, the appellate court may direct the trial court clerk to prepare, certify, and file a supplemental record containing the omitted items. See Tex. R. App. P. 34.5(c). It appears that after the severance of the case involving A.E.R. Jr., into Cause No. DC-21-238-1, no documents from Cause No. DC-21-238 pertaining to A.E.R., Jr. were transferred to Cause No. DC-21-238-1. For example, the clerk's record does not contain, among other things:
1. The original petition
2. Any orders pertaining to the protection of a child in an emergency
3. Notices of hearings
4. Status reports to the trial court
5. Temporary orders following adversary hearings
6. Family plans
7. Permanency reports
8. Docket notes
9. Permanency hearing orders
10.Orders of appointment
Accordingly, we order the trial court clerk to file a supplemental clerk's record containing all of the documents above as they pertain to A.E.R., Jr. in Cause No. DC-21-238 (In the Interest of A.E.R., J.r., and G.R.S., children), along with any other record documents from Cause No. DC-21-238-1, not already included in the clerk's record filed February 21, 2024, in this court on or before March 15, 2024.
