IN RE 101 LEXINGTON TOWER, LLC and LEX AVENUE HOTEL, LLC, Relators

Original Mandamus Proceeding

This proceeding arises out of Cause No. 2022-CI-09922, pending in the 37th Judicial District Court, Bexar County, Texas, the Honorable Marialyn Barnard presiding.

Sitting: Beth Watkins, Justice Lori I. Valenzuela, Justice Lori Massey Brissette, Justice

ORDER

PER CURIAM.

On July 8, 2024, relators filed a petition for writ of mandamus, asserting the trial court abused its discretion when it denied relators' motion for leave to file a third-party petition. On July 17, 2024, relators supplemented the mandamus record with a transcript of the June 13, 2024 hearing on relators' motion for leave. However, the mandamus record does not contain a written order denying relators' motion for leave, and the supplemented transcript does not contain a ruling on the motion. Accordingly, relators failed to provide "a certified or sworn copy of [the] order complained of, or any other document showing the matter complained of," as required by the Texas Rules of Appellate Procedure. See Tex. R. App. P. 52.3(k)(1)(A).

Relators shall file either the complained of order, or a transcript reflecting the complained of ruling, by August 30, 2024, or their mandamus petition is subject to being dismissed.

It is so ORDERED.
