DECISION ORDER ON APPLICATION FOR REINSTATEMENT

Application by the respondent for reinstatement as an attorney and counsel-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 23, 1954. By opinion and order of this court date February 19, 1991, he was disbarred upon his resignation from the practice of law. By decision and order on application of this court dated November 16, 1999, his first application for reinstatement was denied. By further decision and order on second application for reinstatement was denied. By subsequent decision and order on motion of this court dated March 15, 2001, his motion for reargument of his second application for reinstatement was also denied. By decision and order on application of this court dated April 17, 2003, his third application for reinstatement was held in abeyance, and the matter was referred to the Committee on Character and Fitness to investigate and report on his current fitness to be an attorney.

Upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

ORDERED that the application is granted; and it is further,

ORDERED that, effective immediately, the respondent is reinstated as an attorney and counselor-at-law and the Clerk of the court is directed to restore the name of Harry Waitzman to the roll of attorneys and counselors-at-law.
