ORDER TO SHOW CAUSE
The Advisory Committee on Judicial Conduct having filed a formal complaint against SUPERIOR COURT JUDGE RANDOLPH M. SUBRYAN charging him with violations of Canons 1 (A Judge Should Uphold the Integrity and Independence of the Judiciary) and 2A (A Judge Should Avoid Impropriety and the Appearance of Impropriety in All Activities) of the Code of Judicial Conduct and Rule 2:15-8 (a) (6) (a judge should not engage in conduct prejudicial to the administration of justice that brings the judicial office into disrepute);
And the Committee having concluded by clear and convincing evidence that respondent violated the Canons and Rule as charged;
And the Committee having filed a Presentment with the Court that recommended respondent be censured for his misconduct;
And good cause appearing;
It is ORDERED that pursuant to Rule 2:15-17 (b) (2), SUPERIOR COURT JUDGE RANDOLPH M. SUBRYAN is to show cause before this Court why he should not be publicly disciplined through the imposition of an appropriate sanction that does not include removal from judicial office; and it is further
ORDERED that Patrick J. Monahan, Jr., Esquire, shall present this matter to the Court; and it is further
ORDERED that the parties shall file briefs on this Order to Show Cause, with respondent's brief to be served and filed on or before January 5, 2005, and the Presenter's brief to be served and filed on or before January 25, 2005; and it is further
ORDERED that the matter shall be set down for oral argument on Tuesday, February 1, 2005, at 2:00 p.m., in the Supreme Court Courtroom, Hughes Justice Complex, Trenton.
