ORDER REJECTING RESIGNATION AFFIDAVIT
On March 3, 2006, respondent tendered his Resignation Affidavit. On March 27, 2006, the Indiana Supreme Court Disciplinary Commission filed a fifteen count verified complaint alleging acts of attorney misconduct by respondent. The Commission submitted a letter along with its verified complaint questioning the adequacy of respondent's affidavit. Respondent submitted a letter in response, which the Court received on April 12, 2006.
And this Court, being duly advised, now finds that respondent's Resignation Affidavit does not meet the necessary elements of an affidavit of resignation as required by Ind. Admission and Discipline Rule 23 § 17. Accordingly, we find that respondent's Resignation Affidavit should not be approved.
IT IS, THEREFORE, ORDERED that respondent's Resignation Affidavit is hereby rejected as not in compliance with Admis.Disc.R. 23 § 17.
The Clerk of this Court is directed to forward notice of this Order to the respondent or his attorney, and to the Indiana Supreme Court Disciplinary Commission.
