Opinion

Case No. 49S00-0503-DI-119.

May 9, 2006.

ORDER GRANTING THE RESPONDENT A SECOND EXTENSION OF TIME TO FILE A PETITION FOR REVIEW

Comes now the respondent, by counsel, and requests a fourteen (14) day extension of time, to and including May 17, 2006, to file a Petition for Review. This Court previously granted respondent an extension of time by order dated February 17, 2006. Co-counsel states that a death in lead counsel's family has necessitated his absence from his office and that co-counsel will be completing the Petition for Review.

And this Court, being duly advised, now finds that the request for extension of time should be granted, to and including May 17, 2006, provided, however, that further extensions of time for the respondent during this briefing schedule will not likely be granted.

IT IS, THEREFORE, ORDERED that the respondent, Merrill Moores, is granted an extension of time, to and including May 17, 2006, to file a Petition for Review.

The Clerk of this Court is directed to forward notice of this Order to the respondent or his attorney and to the Indiana Supreme Court Disciplinary Commission.
