Case No. 49S00-0503-DI-119.
June 26, 2006.
ORDER GRANTING THE RESPONDENT AN EXTENSION OF TIME TO FILE A RESPONSE BRIEF
Comes now the respondent, by counsel, and requests a thirty (30) day extension of time, to and including July 31, 2006, to file a Response Brief that is currently due on July 3. This Court previously granted respondent two extensions of time to file his petition for review in this matter. Counsel states that a criminal trial starting on July 6 and expected to last until July 21, and co-counsel's absence from the office until June 26, necessitates the requested extension. The Indiana Supreme Court Disciplinary Commission objects to the requested extension, but does not object to an extension of fourteen (14) days to July 17, 2006.
And this Court, being duly advised, now finds that the request for an extension of time should be granted, but only to and including July 17, 2006, provided, however, that further extensions of time for the respondent during this briefing schedule will not RTS be granted.
IT IS, THEREFORE, ORDERED that the respondent, Merrill Moores, is granted an extension of time, to and including July 17, 2006, to file a Response Brief.
The Clerk of this Court is directed to forward notice of this Order to the respondent or his attorney and to the Indiana Supreme Court Disciplinary Commission.
