LIMITED PROTECTIVE ORDER
This attorney discipline case includes allegations of sexual misconduct with minors. On September 12, 2006, upon motion of the Indiana Supreme Court Disciplinary Commission, this Court issued an order sealing the proceedings in this matter ("Protective Order"). Before the Commission initiated this matter, several parties, including several minors, filed a civil suit against Respondent and others based in part on the acts alleged by the Commission in this matter. That case, Kennedy v. Haigh, Cause No. 49D13-0602-CT-008125, is pending in the Marion Superior Court. Respondent objected to the use of pseudonyms in the case as originally filed, and the civil case has been re-captioned to use the true names of the adults in the case. The pseudonym "Daughter Doe" is used for one plaintiff who is still a minor. Because of this change in circumstances, on June 15, 2007, the Court vacated the Protective Order without prejudice to any interested party requesting more limited protection.
On July 6, 2007, Daughter Doe, by counsel, filed a "Motion for Limited Protective Order," requesting an order allowing Daughter Doe to continue to be referred to pseudonymously. No objection was filed to this motion. The Court notes that Administrative Rule 9(G)((1)(e)(i), concerning access to court records, states: "[J]uveniles who are victims of sex crimes shall be identified by initials only. . . ."
Being duly advised, the Court GRANTS the motion and directs that Daughter Doe be referred to by her pseudonym or by her initials in documents filed in this case until further order of this Court, and that all provisions of Administrative Rule 9 be followed.
The Clerk of this Court is directed to send a copy of this Order to the parties in this cause or their respective attorneys, to the hearing officer, and to post this Order on the Court's website for orders concerning attorney disciplinary cases.
