ORDER DIRECTING EXPEDITED RESOLUTION

RANDALL T. SHEPARD, Chief Justice of Indiana.

Pursuant to our interest in prompt resolution of attorney disciplinary matters, the Court, sua sponte, has examined the records in this case and notes that this case has been pending since January 21, 2004, and is set for a pre-trial conference on October 18, 2005. Accordingly, we direct the hearing officer, the Hon. James W. Rieckhoff, to set a final hearing in this matter not later than February 28, 2006. The hearing officer is further directed to conduct the hearing on the date set unless this Court has previously disposed of the case. No continuances of the hearing shall be permitted without the permission of this Court.

IT IS, THEREFORE, ORDERED that the Hon. James W. Rieckhoff is directed to set a final hearing in this matter not later than February 28, 2006. The hearing officer is further directed to conduct the hearing on the date set unless this Court has previously disposed of the case. No continuances of the hearing shall be permitted without the permission of this Court.

The Clerk of this Court is directed to send a copy of this Order to the Hon. James W. Rieckhoff, Elkhart Superior Court, 315 South Second Street, Elkhart, IN 46516-3138, and the parties in said cause or their respective attorneys.
