Opinion

No. 12S00-9810-DI-615.

ORDER ON PETITION FOR RULE TO SHOW CAUSE

In 2000, this Court suspended Respondent from the practice of law in this state, see In re Edmiston, 729 N.E.2d 97 (Ind. 2000), and he has not been reinstated to date.

The Indiana Supreme Court Disciplinary Commission filed a "Verified Petition for Rule to Show Cause" on May 1, 2007, alleging a letter Respondent sent to person who had been involved in a traffic accident with Respondent's son created the impression that Respondent was acting as his son's attorney. The Court concludes that the letter would likely lead the recipient to conclude Respondent was acting as his son's attorney. The incident, however, appears to be an isolated one, and in his response to the Commission's Petition, Respondent expressed regret and stated he will refrain from any future activity that could have the appearance of practicing law.

Being duly advised, the Court admonishes Respondent for sending the letter and directs Respondent to refrain from any misleading communications in the future. No penalty or costs shall be imposed. Any future violation will likely be treated more severely.

The Court directs the Clerk to forward a copy of this Order to Respondent or Respondent's attorney and to the Indiana Supreme Court Disciplinary Commission.

Done at Indianapolis, Indiana, this 26th day of July, 2007.

All Justices concur.
