ORDER DISMISSING ACTION

RANDALL T. SHEPARD, Chief Justice of Indiana.

On June 28, 2004, the Indiana Supreme Court Disciplinary Commission filed a Verified Complaint for Disciplinary Action against the respondent. Subsequently, on January 27, 2006, the Commission filed a Motion to Dismiss, advising the Court the respondent had died on January 26, 2006.

And, the Court being duly advised now finds that the Commission's motion should be GRANTED.

IT IS, THEREFORE, ORDERED that the Verified Complaint for Disciplinary Action filed on June 28, 2004, is hereby dismissed as moot.

The Clerk of this Court is directed to forward notice of this Order to the respondent's attorney and to the Indiana Supreme Court Disciplinary Commission.
