MEMORANDUM OPINION


By letter dated December 29, 2008, the Clerk of the Court notified appellant C.M.D. that his brief filed on November 3, 2008 did not comply with the rules of appellate procedure. The Clerk directed him to file an amended brief within ten days. Appellant did not respond. On February 2, 2009, the Clerk mailed appellant a second letter directing him to file a brief and an extension motion within ten days or the appeal would be dismissed. To date, appellant has not filed an amended brief nor responded in any manner to the Clerk's directives.

Accordingly, we DISMISS this appeal. See Tex. R. App. P. 42.3(c).
