Opinion

No. 05-05-00680-CV

Opinion Issued July 18, 2005.

On Appeal from the 304th Judicial District Court, Dallas County, Texas, Trial Court Cause No. JD-56399-W.

Before Justices MORRIS, LANG, and MAZZANT.

MEMORANDUM OPINION

Appellant filed his notice of appeal in the trial court on January 19, 2005 and in this Court on May 18, 2005. In letters dated May 18, 2005, we instructed appellant to file his $125 filing fee and his docketing statement. In letters dated May 20, 2005, we instructed appellant that we had received notice from the district clerk that the clerk's record had not been filed because appellant had not paid for the record or made arrangements to pay for the record. We instructed appellant to provide the Court with written verification by May 30, 2005 that he had paid or made arrangements to pay for the record. We cautioned appellant that his appeal would be dismissed for want of prosecution if he failed to comply with our request. On May 31, 2005, appellant filed a motion for an extension of time to file his docketing statement and his $125 filing fee. We granted both requests and ordered the docketing statement filed and the fee paid no later than June 24, 2005. To date, appellant has not filed a docketing statement, paid his filing fee, or paid or made arrangements to pay for the clerk's record.

Accordingly, we DISMISS this appeal for want of prosecution.
