Opinion

No. 4-86-0198.

September 17, 1986.

Appeal from the Circuit Court for Broward County; Bobby Gunther, Judge.

Frederick C. Heidgerd of Heidgerd Martin, P.A., Fort Lauderdale, for appellant/intermediary.

No appearance for appellee.

We find, based on the record, that the trial court abused its discretion when it limited fees under section 63.097, Florida Statutes (1984), to no more than $500, regardless that a larger fee would be patently warranted and reasonable.

We reverse and remand with respectful instructions to reconsider the award.

REVERSED AND REMANDED.

DOWNEY, LETTS and WALDEN, JJ., concur.
