MEMORANDUM Opinion


Appellant gave notice of appeal in this cause in June 2003. Appellant did not pay the filing fee and did not timely file an affidavit of indigence. See TEX. R. APP. P. 20.1(c)(1). The clerk of this Court notified Appellant on July 2, 2004 that "filing fees in the amount of $135.00 for motions or other filings" had not been paid. Appellant was further advised that pursuant to TEX. R. APP. P. 42.3(c), "the appeal will be dismissed unless the filing fee or an explanation showing a proper basis for not paying the filing fee is received on or before July 12, 2004." Appellant has not paid the fee or otherwise filed a response.

Therefore, this appeal is dismissed. TEX. R. APP. P. 42.3(c).
