ORDER ASSIGNING MEDIATOR


This appeal was referred to mediation on February 2, 2005. The parties have not filed a notice with the Court identifying an agreed mediator. Thus, the Court assigns the Dispute Resolution Center, 1314 East 29th St., Bryan, Texas 77802, (979) 822-6947, to mediate this appeal under the February 2, 2005 order.

Mediation must take place within 30 days after the date of this order. Immediately after mediation, the mediator must advise the Court, in writing, only that the case did or did not settle and the terms of its fee agreement.

This appeal is abated, and all appellate timetables, other than mediation, are suspended until further notice of the Court.
