MEMORANDUM OPINION


On October 13, 2010, the Court ordered appellant Robert B. Roach to file, within fifteen days, either his brief or a motion to dismiss the appeal setting forth that the parties have settled. We warned that failure to comply would result in dismissal of the appeal without further notice. See Tex. R. App. P. 42.3(c). To date, appellant has not filed his brief nor has he otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal.
