MEMORANDUM OPINION


From our initial review of the record it appeared that the trial court had granted a new trial on this matter on August 22, 2005. Therefore, on January 13, 2006, we ordered appellant to show cause in writing by January 30, 2006, why this appeal should not be dismissed for lack of jurisdiction. Appellant has not responded that order.

Therefore, this appeal is dismissed for lack of jurisdiction. See Tex.R.App.P. 42.3(a). Costs of appeal are taxed against appellant.
