Opinion

No. 04-05-00025-CV

Delivered and Filed: March 16, 2005.

Appeal from the 288th Judicial District Court, Bexar County, Texas, Trial Court No. 2004-PA-01668, Honorable Karen Pozza, Judge Presiding.

Dismissed for Want of Jurisdiction.

Sitting: Catherine STONE, Justice, Sarah B. DUNCAN, Justice, Karen ANGELINI, Justice.

MEMORANDUM OPINION

The trial court signed a decree terminating appellant's parental rights on November 15, 2004. Because this is an accelerated appeal, the notice of appeal was due on December 6, 2004. See TEX. R. APP. P. 26.1(b). A motion for extension of time to file the notice of appeal was due on December 21, 2004. See TEX. R. APP. P. 26.3. Appellant filed a notice of appeal and a motion for extension of time to file the notice of appeal on January 11, 2005. Accordingly, on February 11, 2005, this court ordered appellant to file, by February 22, 2005, a response presenting a reasonable explanation for failing to file the notice of appeal in a timely manner. No response has been filed. Therefore, this appeal is dismissed for lack of jurisdiction. See Tex.R.App.P. 42.3.
