Opinion

No. 76-571.

July 21, 1976.

Interlocutory appeal from Circuit Court, Pinellas County; Jack E. Dadswell, Judge.

Duane N. Ivester and Chester G. Senf, Jacksonville, and Nyjola S. Grybauskas, St. Petersburg, for appellant.

Robert J. Finck, Walter J. Hunston, Jr., Mark I. Shames and Richard A. Jacobson, Legal Aid Society, St. Petersburg, for appellee.

This court sua sponte finds that the order on the discovery motion appears to be a nonappealable interlocutory order. Considering the petition as one for review by common law certiorari, the petition should be, and it is hereby, denied as we find no departure from the essential requirements of law.

McNULTY, C.J., and BOARDMAN and GRIMES, JJ., concur.
