MEMORANDUM OPINION
Appellant Reginald Dean filed a notice of appeal on February 22, 2007. On April 18, 2008, we granted appellant's motion to extend time to file his brief. We ordered appellant to file his brief complying with the rules of appellate procedure by May 18, 2008. In the April 18, 2008 order, we advised appellant that because his brief was already several months overdue, no further extensions of time would be granted.
Appellant filed a deficient brief on May 16, 2008. By letter dated May 20, 2008, we notified appellant that his brief was deficient and directed him to file a brief complying with Texas Rule of Appellate Procedure 38.1 by May 30, 2008. See Tex. R. App. P. 38.1.
By order of August 28, 2008, we denied appellant's letter request of June 3, 2008 that his deficient brief serve as his brief. On August 28, 2008, we ordered appellant to file an amended brief complying with Texas Rule of Appellate Procedure 38.1 within ten days. We advised that if appellant's amended brief complying with Rule 38.1 was not filed within ten days of that order, we would dismiss this appeal for want of prosecution. See Tex. R. App. P. 42.3(b) and (c).
To date appellant has failed to file a brief complying with Texas Rule of Appellate Procedure 38.1. Accordingly, we DISMISS this appeal for want of prosecution. See Tex. R. App. P. 38.1.
