ORDER


This is a habeas case brought pursuant to 28 U.S.C. § 2254. Petitioner is an inmate in the Texas Department of Criminal Justice, Correctional Institutions Division ("TDCJ-CID"). Respondent is Doug Dretke, Director of the TDCJ-CID. Pursuant to 28 U.S.C. § 636(b), and an order of the court in implementation thereof, this action was referred to the United States magistrate judge for proposed findings and recommendations. On March 9, 2005, the Findings, Conclusions and Recommendation of the United States Magistrate Judge were filed, to which Petitioner filed written objections on March 23, 2005.

Having independently reviewed the pleadings, file and record in this case and the findings and conclusions of the magistrate judge, the court concludes that the findings and conclusions are correct. Petitioner's objections are overruled, and the magistrate judge's findings and conclusions are hereby accepted as those of the court. Accordingly, Petitioner's Petition For A Writ of Habeas Corpus By A Person In State Custody, filed by the clerk on September 20, 2002, is hereby denied, and this action is dismissed with prejudice.

It is so ordered.
