This case is calendared for a remote trial at the session of the Court scheduled to commence on February 27, 2023, for cases in which Portland, Oregon, is the place of trial.

On January 13, 2023, respondent filed a motion for document subpoena hearing. By order issued January 18, 2023, the Court granted respondent's motion and scheduled this case for hearing on the status of the case at a Washington, D.C., special hearing session of the Court to be conducted remotely at a date and time certain of 1:00 p.m. (Eastern Time) on Wednesday, February 15, 2023.

On February 6, 2023, respondent filed a status report. In that status report, respondent represents that the special hearing session of the Court, is "no longer being requested as the parties are working towards a settlement." Consequently, the Court will strike this case for hearing from the Court's February 15, 2023, special hearing session.

Upon due consideration and for cause, it is

ORDERED that this case is hereby stricken from the special hearing session of the Court scheduled commence on Wednesday, February 15, 2023, at 1:00 p.m. (Eastern Time).
