Appeal from the Supreme Court, New York County (Sheila Abdus-Salaam, J.).


The motion, in effect one to vacate a prior order dismissing the action because of plaintiffs failure to appear at a preliminary conference ( 22 NYCRR 202.27), was properly denied in the absence of a showing of merit ( see, Fink Weinberger v. Rosenkrantz, 252 A.D.2d 368; Van Kleeck v. Horton Mem. Hosp., 251 A.D.2d 1022) to the cause of action for so-called harassment ( see, Wehringer v. Helmsley-Spear, Inc., 59 N.Y.2d 688; General Motors Acceptance Corp. v. Desbiens, 213 A.D.2d 886, 888).
