ORDER

Patrick J. Urda, Judge

This case is before the Court on the Commissioner's motion to withdraw his motion for summary judgment. Petitioner, George C. Iatrellis, filed a response objecting to the motion to withdraw. On due consideration, we will grant the motion to withdraw and order the parties to file a stipulated decision document within 30 days. If at that time the parties have not agreed to a stipulation settling all issues, including any claims for litigation and administrative costs, see § 7430 and Rules 230 and 231,1 the Court will hold a conference call with the parties. It is therefore

ORDERED that the Commissioner's motion to withdraw, filed July 28, 2022, is granted, and the Commissioner's motion for summary judgment, filed on April 15, 2021, is deemed withdrawn. It is further

ORDERED that the parties shall, no later than September 12, 2022, file a stipulated decision.
