On July 28, 2022, the Commissioner filed a motion to withdraw his motion for summary judgment. In his motion to withdraw, the Commissioner indicates that he concedes the determinations set forth in the Notice of Determination issued to petitioner George C. Iatrellis on October 19, 2016, are not sustained, and is in the process of abating the underlying assessments for those tax years. Upon due consideration, it is

ORDERED that, on or before August 11, 2022, Mr. Iatrellis shall file an objection to the Commissioner's motion to withdraw, if any.
