Hynes v. Hageville Realty Company

Appellate Division of the Supreme Court of New York, Second Department
Oct 1, 1917
180 App. Div. 903 (N.Y. App. Div. 1917)

Opinion

October, 1917.

Judgment and order reversed, with costs, and complaint dismissed, with costs. There is no evidence impairing the good faith of the mortgagee in taking possession of the mortgaged chattels. This court does not pass upon the legality of the sale. If it was illegal, the plaintiff has other and appropriate remedy. Jenks, P.J., Thomas, Stapleton, Mills and Rich, JJ., concurred.
