ORDER
Emin Toro, Judge
This case is currently calendared for trial during the Court's April 4, 2022, San Francisco, California, trial session. On March 4, 2022, petitioner filed a Motion to Proceed Remotely (Doc. 13). On March 11, 2022, respondent filed a Motion to Dismiss for Lack of Jurisdiction as to Gareth Corwin Hyndman II and to Change Caption (Doc. 14). On March 14, 2022, petitioner filed a Motion to Strike Respondent's Motion to Dismiss (Doc. 15) as moot.
On March 14, 2022, the Court held a conference call with the parties to discuss the current status of the case and the above-referenced motions. As discussed with the parties during the call, the Court's December 14, 2021, Order provided the relief sought in respondent's Motion to Dismiss; therefore, the Court will deny respondent's motion as moot. As also discussed with the parties, to give the parties additional time to exchange documents and engage in possible settlement discussions, the Court will hold petitioner's Motion to Proceed Remotely in abeyance.
Upon due consideration, it is hereby
ORDERED that petitioner's Motion to Proceed Remotely filed March 4, 2022, is held in abeyance. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Jurisdiction as to Gareth Corwin Hyndman II and to Change Caption filed March 11, 2022, is denied as moot. It is further
ORDERED that petitioner's Motion to Strike Respondent's Motion to Dismiss filed March 14, 2022, is denied as moot.
The parties are reminded that this case remains calendared for trial during the Court's April 4, 2022, San Francisco, California, trial session.
