ORDER AND FINAL JUDGMENT
This case is before the Court on Magistrate Judge John M. Facciola's Report and Recommendation on the parties' cross-motions for summary judgment, recommending that plaintiffs' motion be denied and defendants' motion be granted.
Local Civil Rule 72.3(b) provides that when a matter is referred to a magistrate judge for a report and recommendation on a motion for summary judgement, "[a]ny party may file written objections to the magistrate judge's proposed findings and recommendations . . . within ten days after being served with a copy thereof." Magistrate Judge Facciola issued his Report and Recommendation on March 2, 2005. The parties have filed no objections within the time period set forth in the rule.
Upon consideration of the March 2, 2005 Recommendation of Magistrate Judge John M. Facciola, the parties' lack of objections thereto, and the entire file herein, it is hereby
ORDERED that Magistrate Judge Facciola's Report and Recommendation is ADOPTED; it is
FURTHER ORDERED that [8] plaintiffs' motion for summary judgment is DENIED; it is
FURTHER ORDERED that [11] defendants' motion for summary judgment is GRANTED; it is
FURTHER ORDERED that JUDGMENT is entered for defendant; it is
FURTHER ORDERED that this case is DISMISSED from the docket of this Court; and it is
FURTHER ORDERED that this Order and Judgment shall constitute a FINAL JUDGMENT in this case. This is a final order. See FED. R. APP. P. 4(a).
