ORDER
Pending before the Court is three Motions in Limine filed by the parties [Doc. No.'s 606, 608 and 609.] Since the filing of these Motions, the procedural posture of this case has changed significantly. For example, since the time the Motions were filed, the Court has held three additional pre-trial conferences during which the Court discussed many of the issues contemplated in the briefs. In addition, the Court is currently considering a Motion for Summary Judgment and Motion for Reconsideration. Accordingly, the Court finds that the Motions in Limine should be denied, without prejudice and with leave to refile, if necessary. For the foregoing reasons,
IT IS ORDERED Hydranautics' Motion in Limine to exclude evidence of expert witnesses [Doc. No 606] is DENIED without prejudice and with leave to refile. IT IS FURTHER ORDERED Hydranautics' Motion in Limine to exclude speculative testimony of Filmtec witnesses [Doc. No 608] is DENIED without prejudice and with leave to refile.
IT IS FURTHER ORDERED Filmtec's Motion in Limine to exclude evidence and argument relating to whether Filmtec adequately investigated the facts or researched the law relating to Filmtec's claims in the infringement action [Doc. No 609] is DENIED without prejudice and with leave to refile.
IT IS SO ORDERED.
