Petitioners sought a review by the trial court of the action of the Board of Commissioners of the Town of Wake Forest in adopting on 1 February 1984 Ordinance No. 84-2 entitled: "An Ordinance to Extend the Corporate Limits of the Town of Wake Forest, Under the Authority Granted by Part 2, Article 4A, Chapter 160A of the General Statutes of North Carolina." The superior court entered judgment holding the ordinance valid and affirming the action of the Board of Commissioners in adopting it, from which judgment the petitioners appealed to the Court of Appeals. The Court of Appeals unanimously affirmed the trial court. The petitioners' petition for discretionary review was allowed by this Court on 3 September 1987. Heard in the Supreme Court 7 December 1987.
