AUTOMOBILES AND MOTOR VEHICLES, § 167.2reversal of judgment for injured pedestrian because of refusal of defendant's instruction on contributory negligence. Judgment for damages for personal injuries, sustained by plaintiff pedestrian when, in city street, he was struck by defendant's truck, held required to be reversed because of trial court's refusal to give contributory negligence instruction offered by defendant. MATCHETT, J., dissenting.
