Defendant-respondent's motion is for an amendment or resettlement of the record on appeal and for permission to reargue the appeal upon such resettled record. The motion for the amendment and resettlement of the record is remitted to Hon. ANDREW W. RYAN, the Justice who held the Special Term at which the order appealed from was granted on July 11, 1947. The motion for reargument is denied, without prejudice and without costs.
