Whipple, C.J., dissents and would not consider the writ for the reasons outlined below. Namely, relators failed to comply with Uniform Rules of Louisiana Courts of Appeal, Rules 4-5(A), in that the application does not contain a notarized affidavit verifying the allegations of the application and certifying that a copy has been delivered or mailed to the respondent judge and to opposing counsel, and to any opposing party not represented by counsel. The affidavit further fails to list all parties and all counsel and fails to list the addresses and telephone numbers of the respondent judge, opposing counsel, and any opposing party not represented by counsel. Relators also failed to include a signed return date order as required by Rule 45(C)(11). COURT OF APPEAL, FIRST CIRCUIT /s/_________
