ORDER

Alina I. Marshall, Judge.

This case is calendared for a remote trial at the session of the Court scheduled to commence on November 14, 2022, for cases in which Richmond, Virginia, is the place of trial.

On October 12, 2022, respondent filed a motion to dismiss for lack for prosecution. The second page of that motion, reflects a caption for a case different than the instant case. Accordingly, respondent's motion to dismiss for lack for prosecution filed in this case was in error and shall each be stricken from the record.

Upon due consideration of the foregoing, it is

ORDERED that respondent's motion to dismiss for lack for prosecution filed October 12, 2022, at Docket Entry No. 13, is hereby stricken from the record.
