This case is calendared for trial at the June 10, 2024, Albany, New York, Trial Session of the Court.

On April 18, 2024, respondent filed a Motion to Dismiss for Failure to Properly Prosecute (motion to dismiss). Respondent has attempted to contact petitioner by phone and email, numerous times, but petitioner has been unresponsive. Petitioner's view on the granting of this motion is unknown.

Upon due consideration and for cause, it is

ORDERED that, on or before May 6, 2024, petitioner shall file a response to respondent's motion to dismiss. Failure to comply with this Order may result in the granting of respondent's Motion to Dismiss for Failure to Properly Prosecute.
